Facts :


Casio, a global electronics manufacturer, had appointed Riddhi Siddhi as a distributor for their products in India. After the agreement expired, Riddhi Siddhi continued selling goods using Casio’s trademark. Casio claimed this amounted to infringement and unfair business practices.


Findings :


The Delhi High Court ruled that the defendant had no authority to use the trademark after termination. It held that such conduct was an attempt to mislead customers into believing the goods were authorized.


Suggestions :


Trademark licensors should include clear post-termination clauses and monitor former licensees. Courts must treat such misuse seriously to protect brand integrity.
