DRS Logistics, a logistics company, filed a suit against Google LLC and Google India Pvt Ltd, alleging trademark infringement.
DRS Logistics claimed that Google was allowing third-party advertisers to use its registered trademarks "Agarwal Packers & Movers" and "DRS Logistics" as keywords in Google's Ads Program, leading to diversion of web traffic and consumer confusion.
Trademark Infringement : DRS Logistics argued that Google's Ads Program constituted trademark infringement, as the use of its trademarks as keywords led to confusion among consumers.
Unfair Advantage : DRS Logistics contended that Google's policy allowed advertisers to ride on the goodwill of its trademarks, giving them an unfair advantage.
The Delhi High Court ruled that Google's use of DRS Logistics' trademarks as keywords in its Ads Program amounts to "use" under the Trademarks Act, 1999.
The court directed Google to investigate complaints of trademark infringement and take down ads found to be infringing.
However, the court also observed that DRS Logistics' registered trademarks were descriptive in nature, and therefore, the respondents were free from liability for trademark infringement.
