Mankind Pharma v Mankind Agri Seeds

Mankind Pharma, a pharmaceutical company, filed a trademark infringement suit
against Mankind Agri Seeds, an agricultural goods manufacturer, for using a
similar mark. Mankind Pharma alleged that the defendant’s use of “Mankind” was
intended to ride on the goodwill and reputation of the pharmaceutical company .
Trademark infringement: Mankind Pharma claimed that Mankind Agri Seeds’
use of a similar mark was likely to create confusion in the market. - Passing off: The pharmaceutical company argued that the defendant’s actions
constituted passing off, as consumers might believe that the agricultural products
were associated with or endorsed by Mankind Pharma.
The case was decided on November 26, 2024 by Justice Amit Bansal of the
Delhi Highcourt.
The Delhi High Court granted relief to Mankind Pharma, restraining Mankind Agri
Seeds from using the “Mankind” mark while advertising or selling its products.
The court observed that a prima facie case of infringement and passing off was
made out against the defendant. The court also appointed a Local Commissioner to
conduct a search and seizure of infringing products .
