A landmark Indian judgment recognizing domain names as valuable intellectual property and extending trademark protection principles to the internet era.

Summary

This case is one of India’s earliest and most important decisions dealing with domain name disputes. The Supreme Court examined whether domain names deserve the same legal protection as trademarks and whether passing off principles apply in cyberspace. Satyam Infoway, which owned and used the domain names “sify.com” and “sifynet.com,” alleged that Sifynet Solutions was using deceptively similar domain names to mislead internet users. The Court acknowledged the commercial importance of domain names and firmly held that they function as business identifiers, deserving protection under trademark law.

Facts of the Case

Satyam Infoway Ltd. was an established internet service provider operating under the brand “SIFY” and had registered multiple domain names incorporating the word “sify.” Sifynet Solutions Pvt. Ltd. later registered and used similar domain names containing “sifynet,” offering related internet services. Satyam Infoway claimed that such use created confusion among users and diluted its goodwill. Sifynet argued that domain names are merely addresses on the internet and not subject to trademark-like protection.

Findings / Reasoning

The Supreme Court rejected the narrow view that domain names are only internet addresses. It held that domain names serve the same source-identifying function as trademarks and can acquire distinctiveness and goodwill. The Court applied traditional passing off principles, emphasizing likelihood of confusion, reputation, and misrepresentation. It observed that internet users often rely on domain names to identify the source of services, making deception more likely when similar names are used. The Court clarified that even without statutory registration, common law rights in domain names are enforceable.

Suggestions / Observations

The judgment highlighted the need for businesses to protect their online identity proactively. Companies must secure relevant domain names early and act promptly against confusingly similar registrations. The decision also underscored that intellectual property law must evolve with technological advancements and that cyberspace is not beyond legal regulation.

Judgment & Date

The Supreme Court ruled in favour of Satyam Infoway Ltd., holding that Sifynet’s use of similar domain names amounted to passing off. The Court restrained Sifynet from using the infringing domain names.

Judgment Date : 18 March 2004
