Short Description About the Case


Verizon Trademark Services LLC, proprietor of the internationally recognised “VERIZON” trademark, challenged the use of “VRIZON” by the defendants. The Delhi High Court examined the similarity between the marks, the reputation of the plaintiff's mark and the likelihood of confusion and deception.


Facts


The plaintiffs were associated with the VERIZON brand and claimed extensive use and reputation of the mark in India and internationally.


The defendants were using the mark “VRIZON” in relation to their business activities.

The plaintiffs contended that “VRIZON” was deceptively similar to “VERIZON” and that such use was likely to cause confusion among consumers and take unfair advantage of the reputation and goodwill associated with the plaintiff's mark.


The plaintiffs therefore approached the Delhi High Court seeking protection against trademark infringement and passing off.


Findings


The Court compared the competing marks and considered their visual and phonetic similarity.

The Court also took into account the established reputation and goodwill associated with the VERIZON mark.


The similarity between VERIZON and VRIZON, particularly when considered from the perspective of an ordinary consumer, was found sufficient to raise a likelihood of confusion and deception.

The Court therefore recognised the plaintiff's entitlement to protection against the defendant's use of the deceptively similar mark.

Judgment


The Delhi High Court granted protection to the plaintiffs against the use of the deceptively similar “VRIZON” mark and recognised the strong rights and reputation associated with the “VERIZON” trademark.
